Minister Bexheti Handed Charters to Six Newly Appointed Public Notaries

Minister of Justice, Blerim Bexheti, handed today charters to six newly appointed public notaries, who were appointed to this function and advised them to work honestly, conscientiously and responsibly, pursuant to the Constitution and laws.
"In the future you will upgrade your knowledge and continue to educate yourselves because we have a dynamic legal system. With the appointment of new notaries , the capacity will be strengthened to deal with the workload, it will increase legal security in the country and will ensure the rule of law", said Bexheti.
"Ministry of Justice", he said, “pays great attention to the improvement of notary service, particularly in the preparation of laws which is intended to unburden the courts from non-court cases".
He suggested that the development of the Notary should be aimed at easier resolving of disputes of citizens and for more effective exercise of their rights. According to him, along with increasing of the competence of notaries , the needs of citizens are also increasing .
"With the adoption of the Law on Extrajudicial Procedure, a very important novelty is introduced, notaries act as trustees of the court in the area of inheritance cases that are not contentious," said Bexheti.
With the initiated process for judicial reforms and the need to unburden the courts from undisputed cases, as the Minister suggested, the Law Amending the Law on Enforcement, began to apply from 1 July 2010.
"This law provides that suggestions for enforcement filed before May 26, 2006 which are not final and proposals submitted for enforcement based on authentic documents for which there is no final decision for enforcement rendered, the court will submit them for processing to the notary agent who will act as a trustee of the court", said Bexheti.
Ministry of Justice so far announced 28 competitions. With the newly appointed notary agents, notary service is performed by 177 notary agents currently in Macedonia .
On the territory of Macedonia, according to the Rules on the number and arrangement of the official seats of notaries in the state, the total number of official seats of notaries is determined, which is 219, and 42 notary places remain vacant.
Asked about the Law on Enforcement of Sanctions, Bexheti said that the Ministry of Justice has no parallel working groups and added that work is done pursuant to the Constitution and laws.
"It is a fact is that I signed the draft law which is already submitted for an opinion at certain institutions, and will be soon in the government procedure. It is due to the elimination of some provisions by the Constitutional Court, the decision of the Court is taken into consideration, and of course we have to resolve that situation. With the proposed text of the law it is going to be resolved", said Bexheti.
" We will have, as he said, "state officials and prison police which will not affect the salary , but only the status of employees".
Asked about the Election Code, Bexheti said that within the government there is a Steering Committee which reviewed in detail all the recommendations of the OSCE, ODIHR and the Group of States against Corruption (GRECO).
- Based on those findings, in the Ministry of Justice a working group was formed that worked on this topic and issue in continuity. There were several meetings. From the very beginning all parliamentary parties and non parliamentary parties were invited and they all actively contributed to the Working Group.
“Experts, who were not delegated by the Ministry of Justice or the Government, but by the OSCE and other institutions actively participated with their proposals", said Bexheti.
"These proposals," he added, “are a priority in terms of local elections where the recommendations of the OSCE ODIHR and Greco are respected" . "Working Group will continue to work also in the area of parliamentary and presidential elections, said Bexheti.
